    William F. Harrison Becomes Partner

    Genova, Burns & Vernoia is proud to announce that William F. Harrison will become partner as of January 1, 2008.  Mr. Harrison joined the firm in 2005 as Counsel after a long stint in government service culminating as Policy Director and Chief Counsel of the New Jersey Office of Smart Growth, Department of Community Affairs.  An expert in land use and environmental law, Mr. Harrison is an active member in numerous sections of both the American Bar Association and the New Jersey State Bar Association

    Supreme Court Denies Certification in Sammarone v. Bovino Case

    Genova, Burns & Vernoia co-founding partner, Angelo Genova, successfully opposed a petition for certification submitted to the Supreme Court in the case of Sammarone v. Bovino.  This is a significant decision from the Supreme Court as the matter is now remanded to the trial court for further proceedings in accordance with the Appellate Division decision this past summer in Sammarone v. Bovino, 395 N.J. Super. 132 (App. Div. 2007) in which the Appellate Division ruled that Sammarone is entitled to pursue his claim for compensation from Bovino stemming from the developer's $46 million real estate purchase from the late Leona M. Helmsley.  Genova, representing Sammarone, is assisted by Celia Bosco and Michael Grohs.

    Dena B. Calo will present a seminar entitled "Workplace Investigations" before the Burlington County Bar Association on February 6, 2008 at 4:30 p.m. at the Courthouse in Mount Holly, New Jersey.  Ms. Calo practices employment law litigation in the firm's Camden and Philadelphia offices.

    Genova, Burns & Vernoia partner Sandro Polledri will speak on The Art of Practicing before PERC on January 16, 2008 at the NJ Law Center in New Brunswick.  This seminar is eligible for Pennsylvania and New York continuing legal education credits.  The NJ Institute for Continuing Legal Education hosts this seminar on the Public Employment Relations Commission.

    Founding partner Angelo J. Genova will receive Rutgers School of Law--Newark's Distinguished Alumnus award at a dinner on November 1.  The award celebrates his professional and community achievements.  Genova shares the award with Lawrence E. Bathgate, II.  Alumna Nancy Biberman will receive the Fannie Bear Besser Award for Public Service.

    Genova, Burns & Vernoia is pleased to announce that Emily J. Wexler, Rajiv D. Parikh, and Shannon A. Morales have joined the firm.

    Ms. Wexler is a 2006 graduate of New England School of Law.  She has just completed a clerkship with the Honorable Ariel A. Rodriguez, Presiding Judge of the Appellate Division, Superior Court of New Jersey.

    Mr. Parikh, a 2005 graduate of Rutgers University School of Law, has recently finished a clerkship with the Honorable Tonianne J. Bongiovanni, United States Magistrate, District of New Jersey.

    Ms. Morales is a 2007 graduate of Notre Dame Law School.

    Genova, Burns & Vernoia Prevails in Government Procurement Law Bid Challenge

    Genova, Burns & Vernoia partner Kathleen Barnett Einhorn and associate Rebecca Moll Freed successfully convinced the New Jersey Department of Treasury to reject a bid protest which challenged the award of a multi-million dollar contract for the provision of Advertising and Public Relations Services for the New Jersey Department of Health and Senior Services to a firm client.  In this significant government procurement law matter, the Department of Treasury ruled that GBV's client fully complied with all the requirements in the State's Request for Proposal and was the responsible bidder whose bid will be most advantageous to the State, price and other factors considered.

    GBV Obtains Decision Invalidating State Unemployment Compensation Regulation

    GBV partners Francis J. Vernoia and Kathleen Barnett Einhorn have obtained a significant decision from the Appellate Division of the Superior Court of New Jersey, declaring a New Jersey Department of Labor Regulation (N.J.A.C. 12:17-9.6) invalid.  In an August 1, 2007, decision, the Appellate Division held that the regulation, which authorized unemployment compensation benefits for employees who voluntarily accepted an employer's separation package "so that another employee could continue to work," was inconsistent with the New Jersey Unemployment Compensation Law, N.J.S.A. 43.21-5(a) and the New Jersey Supreme Court's decision in Brady vs. Board of Review, 152 N.J. 197 (1997).  A copy of the decision is available at http://www.judiciary.state.nj.us/opinions/a4026-05.pdf

    GBV Prevails in Statute of Limitations Ruling

    11-2-7477 Thakar v. JFK Medical Center, App. Div. (per curiam) (11 pp.) The plaintiff-physician sued the defendant hospital, claiming breach of his residency contract.  The primary issue on appeal is whether tolling principles applied to preserve this state court action that was originally timely filed in, and later dismissed by, the federal court, after the normally-applicable statute of limitations had already expired.  Because plaintiff did not act promptly to file his state court action after dismissal of his federal action, the appellate panel affirms the state court's dismissal of the case.

    James M. Burns Named Chairman-Elect of Community Health Charities

    GBV Partner James M. Burns was named Chairman-Elect of the Board of Trustees of Community Health Charities at its annual meeting in Austin, TX, on May 11, 2007.  Community Health Charities, based in Arlington, VA, is a national federation of more than 50 voluntary health agencies, which raises more than $60 million annually through workplace giving campaigns.

    GBV Co-Counsel in Pharmacy Benefits Management Litigation Trial Victory

    Genova, Burns & Vernoia partner Francis J. Vernoia served as co-counsel with Washington D.C. firm Williams & Connelly, in the representation of Medco Health Solutions, Inc.,  in defense of a claim brought against it by Horizon Blue Cross of New Jersey.   In the matter, Horizon sought in excess of $100 million in damages from Medco for claims related to Medco's provision of pharmacy benefit management services.  After a four and a half week trial before the Honorable Jonathan N. Harris, J.S.C., Bergen County, Medco was successful in having Horizon's complaint dismissed in its entirety.

    George L. Schneider Now Of Counsel

    GENOVA, BURNS & VERNOIA is pleased to announce that George L. Schneider has joined the firm as Of Counsel.  George Schneider has served the public as the NJ Deputy Attorney General, Attorney General’s Division of Criminal Justice (1970-75), Chief Trial Counsel in the Criminal Division (1973-75) and as the Essex County Prosecutor (1981-86).  In private practice, he has been a prominent criminal and civil trial attorney.  At the Livingston office of Genova, Burns & Vernoia, Mr. Schneider will practice white collar criminal defense, civil litigation and corporate ethics.
