    Michael L. Moore Elected to Board of Trustees of Pride Academy Charter School

    Associate Michael L. Moore was elected to the Board of Trustees of the Pride Academy Charter School.  Opened in September 2008, the Pride Academy Charter School is a tuition free middle school serving families in Newark, Orange, East Orange, and the surrounding districts.  The School’s mission is to provide education to students in grades five through eight with a curriculum of peace, respect, integrity, determination, and empathy.   

     

    Mr. Moore is a member of the Commercial Real Estate, Redevelopment & Environmental Law Practice Group and is based in the firm’s Newark, New Jersey office.

    Angelo J. Genova Appears on Hall Institute Forum

    Partner Angelo J. Genova appeared as a guest on the Hall Institute Forum in a 30-minute television interview where he discussed his career, public policy issues facing New Jersey, and his work with the Hall Institute. 

     

    Mr. Genova will receive the Annual Achievement Award from the Hall Institute of Public Policy at the Annual Gala Reception on March 18, 2010.

    Partner Brian W. Kronick served as a panel speaker at the 31st Annual National Labor Relations Board (NLRB) Labor Law Conference: The Arthur Eisenberg Labor Symposium.  Mr. Kronick spoke on the impact of federal and state court decisions on arbitration practice in New Jersey. The NLRB annual conference addresses current issues and trends in the field of labor law and is held in cooperation with the NJSBA Labor & Employment Law Section, the Rutgers University School of Management and Labor Relations, the New Jersey State AFL-CIO, and NJICLE.

    William F. Harrison to Receive Commercial Real Estate Development Association President's Award

    Partner William F.     Summary Judgment Granted in Partnership Dispute Case

    The Superior Court of New Jersey granted summary judgment in a Partnership dispute case where the Plaintiffs were seeking fair value for their interest in a Partnership.  GBV partner Peter R. Yarem and associate Gregory E. Tomczak represented the Defendants, a New Jersey Limited Partnership and its General Partner. The Court ruled that the Plaintiffs had no statutory right to withdraw from the Partnership and dismissed their Complaint for fair value.  As a result, the Plaintiffs received $22,500 instead of the $4.9 million which they sought to recover.

    Laurence D. Laufer to Speak at New York Campaign Finance Seminar

    Partner Laurence D. Laufer will speak at the Brooklyn Law School Sparer Public Interest Lunch in a seminar entitled, “Money and Politics: Campaign Finance in the 2009 New York City Mayoral Election” on Wednesday, October 21st.  Former General Counsel of the New York City Campaign Finance Board, Mr. Laufer will join Mark Lopez of Lewis, Clifton and Nikolaid to discuss the state of campaign finance laws in New York City in the context of the current mayoral election as well as their role in the local democratic process.  Brooklyn Law professor Joel Gora will moderate.

    Brian W. Kronick to Present at Collective Negotiations and Interest Arbitration Seminar

    Partner Brian W. Kronick will speak at the New Jersey State League of Municipalities seminar on collective negotiations and interest arbitration.  In his capacity as league labor relations counsel, Mr. Kronick will cover the basics in collective negotiations with civilian and law enforcement bargaining units and will cover topics including the process of negotiations, preparation and the scope of negotiations.  The seminar will be held on Monday, October 19 from 8:00 a.m. to 12 p.m. at the Reception Center at PNC Bank Arts Center in Holmdel, NJ.

    John W. Bartlett Joins Friends of Passaic County Parks Board of Trustees; Elected Chairman

    Counsel John W. Bartlett joined the Board of Trustees of Friends of Passaic County Parks, and was elected by his fellow board members to serve as chairman of the foundation’s executive committee.  The non-profit foundation raises funds to benefit the park system of Passaic County, New Jersey.

    Summary Judgment Awarded in First Amendment Civil Rights Case

    Summary judgment was awarded in a First Amendment civil rights case where the Plaintiff claimed she had been fired by her employer, a New Jersey municipality, based on her participation in a union organizing effort.  Partner Sandro Polledri represented the Defendant and proved that the reason for the Plaintiff’s termination was due to the Client’s restructuring and cost-saving efforts.  Moreover, the individual who recommended the Plaintiff’s position be eliminated had no knowledge of the plaintiff’s union activities.

    Summary Judgment Granted in Long-Term Disability Case

    Yesterday, the United States District Court granted summary judgment in an ERISA, long-term disability case.  Partner James Bucci and Associate Dena B. Calo represented the Defendants, a global professional services firm and a leading diversified health care benefits company, and demonstrated that the Defendants had not abused their discretion in terminating the Plaintiff’s long-term disability benefits.

    The Daily Politics Reports Thompson Campaign Complaint Against Mayor Bloomberg

    Yesterday, The Daily Politics blog (published by the New York Daily News) reported a complaint, filed by New Yorkers for Bill Thompson, alleging that Mr. Thompson’s opponent, incumbent Mayor Michael Bloomberg, violated the New York City Campaign Finance Act by failing to disclose over $3.35 million in political contributions. The Daily Politics blog referenced the Genova, Burns & Vernoia Corporate Political Activity Law Blog’s discussion of the complaint.

    First Amendment Retaliation Case Dismissed

    District Court Judge Peter Sheridan dismissed a First Amendment retaliation case in the United States District Court. Initially, to resolve a disagreement as to which union represented certain County law enforcement officers, the County filed a petition before the Public Employment Relations Commission.  One of the police unions, PBA 54, responded with a lawsuit against the County claiming that the petition was a vehicle to discourage PBA 54 and its members from exercising their Constitutional rights of free speech and freedom of association.  Partners Angelo J. Genova and Sandro Polledri filed a motion to dismiss on behalf of the County. Judge Sheridan, sitting in Trenton, agreed that the County did not retaliate against PBA 54 for exercising their Constitutional rights and granted the motion to dismiss.

    GBV Recognized for Pro Bono Work with Project Pride

    Genova, Burns & Vernoia was recognized in Sunday’s Star-Ledger for its pro bono work with Project Pride, a New Jersey non-profit corporation founded by noted sports columnist and author, Jerry Izenberg.  Project Pride was dedicated to the academic and recreational enrichment of the children of Newark.  GBV assisted with the dissolution of Project Pride and facilitated the donation of the organization’s remaining funds of approximately $28,000 to the Greater Newark Fresh Air Fund.

    Keith A. Krauss to Conduct Seminars at Janome Institute

    Counsel Keith A.     William F. Harrison to Moderate at NAIOP Seminar

    Partner William F. Harrison will moderate at the NAIOP seminar entitled, “Regulatory Update: Site Remediation & Planning” on June 23rd at The Pines Manor in Edison, New Jersey.  Following a keynote speech by NJDEP Commissioner Mark Mauriello, the program will consist of two panels discussing, “Planning Issues” and “Site Remediation.”  Mr. Harrison will moderate the "Planning Issues" panel and will be joined by panelists Jeanne Herb and Larry Baier, DEP; Anthony DiLodovico, CMX; Dianne Brake, PlanSmart NJ; and a county planner, who will discuss water quality management planning, global warming response act and state plan.

    GBV Partners Francis J. Vernoia and Kathleen Barnett Einhorn Prevail on Appeals Challenging Denial of Benefits in Mass Unemployment Case

    GBV Partners Francis J. Vernoia and Kathleen Barnett Einhorn successfully defended appeals brought by hundreds of individuals who had challenged decisions denying their entitlement to New Jersey unemployment compensation benefits.  The individuals brought hundreds of the appeals challenging verdicts which Mr. Vernoia and Ms. Einhorn had obtained after a lengthy trial. On June 5, 2009, the Appellate Division of the Superior Court issued a series of decisions upholding the verdicts and denying the individuals’ claimed entitlement to benefits.

    Mr. Vernoia is director of and Ms. Einhorn a member of the firm's Complex Commercial Litigation Practice Group.  Both attorneys are based in the Newark, New Jersey office.

    Angelo J. Genova Ends Two-Year Successful Term as Chairman of the Section on Labor and Employment Law of the New Jersey State Bar Association

    Partner Angelo J. Genova has completed his tenure as Chairman of the Section on Labor and Employment Law of the New Jersey State Bar Association after two years of service.

     

    Mr. Genova is a leading member of the New Jersey State Bar and has represented management for several decades in traditional labor and employment matters in the private and public sectors.  During his time as Chairman of one of the largest sections of the New Jersey Bar Association, Mr. Genova initiated programs to expand membership diversity, introduce electronic communications as the preferred means to communicate with the section's 1,000 plus members and foster relationships with law schools and students interested in the practice of labor and employment law.

     

    Mr. Genova was succeeded as Chair at the New Jersey State Bar Association’s annual meeting in May at which time Steven R. Cohen, Esq. of Selikoff & Cohen was elected Chairman.

    Peter Cammarano Receives Successful Appellate Court Decision in Election Law Matter

    Associate Peter J. Cammarano III received successful trial and appellate court decisions in an election law matter, where a candidate appealed a trial court order denying her petition seeking to have her name placed on the ballot as a candidate for Essex County Register of Deeds, in the June 2, 2009 Democratic primary election.  The petition was initially rejected because it was determined that it did not contain the required 100 valid signatures.  The appellate court upheld the trial court decision in which Mr. Cammarano litigated the case and demonstrated that the petition fell short by two signatures.

    Angelo J. Genova Serves as Chairman of the Annual Cherry Blossom Gala

    Angelo J. Genova will serve as Chairman of this year's Cherry Blossom Gala event being held on Tuesday, April 14th at Nanina's in the Park.  Honorees for the event are Lisa P. Jackson, Administrator of the Environmental Protection Agency, who will receive the 2009 New Lion of Branch Brook Park Award and Mayor of Newark, the Honorable Cory A. Booker, who will receive the 2009 City Beautiful Award of Caring.  The event will begin with guided bus tours of Branch Brook Park followed by dinner and the awards ceremony.

    Angelo J. Genova Honored at Montclair State University Annual Scholarship Dinner

    Partner Angelo J. Genova was recognized as a Carpe Diem Honoree at the Montclair State University Annual Scholarship Dinner.  Mr. Genova is a 1975 graduate of MSU and currently serves as a member of the Montclair State University Foundation Board of Trustees.  “Angelo is an especially valued friend of Montclair State University," said Nader Tavakoli, Esq. ’80, Chair of the Montclair State University Foundation, “who always finds the time and the occasion to advocate for the University, and to provide assistance with his sage advice and generous support.”

    John C. Petrella Featured in Regional General Counsel Magazine as Employment Law Roundtable Participant

    Partner John C. Petrella, director of the GBV Employment Law & Litigation Practice Group, was featured in the March 2009 Regional General Counsel magazine, published by the New Jersey Law Journal, for his participation in an employment law roundtable entitled, “Employment Law: A Changing Practice.”  Other roundtable participants were Patrick G. Brady, director at Gibbons in Newark and Vincent A. Cino, partner at Jackson Lewis in Morristown.  Anne Dorfman, freelance reporter, moderated the roundtable discussion.

    Angelo J. Genova Named "Italian of the Year"

    Partner Angelo J. Genova was recognized as "Italian of the Year" by the "Italians Who Celebrate St. Patrick's Day Committee" at the 35th Annual St. Patrick's Day/St. Joseph's Day Celebration held at the North Ward Center.  The "Italian of the Year" award was presented to Mr. Genova by Essex County Chief of Staff, Phil Alagia.  Newark Police Director, Garry McCarthy, was recognized as "Irishman of the Year" and was presented his award by City of Newark Mayor, Cory A. Booker.

    Nicholas J. Repici to Speak at 2009 LEAD New Jersey Program

    GBV Employment Law & Litigation Practice Group Holds ADA Seminar

    Partner James Bucci and Associates Dena B. Calo and Shannon A. Morales, members of the Genova, Burns & Vernoia Employment Law & Litigation Practice Group, will be presenting a seminar entitled, “ADA and the Impact of the 2008 Amendments in New Jersey.”  The seminar will cover issues regarding who is considered disabled, placing greater focus on the employer’s actions and not the employee’s disability, what is a reasonable accommodation and requirements for medical and drug testing and recordkeeping.  This seminar is designed for human resource managers, attorneys, benefits managers, risk managers, rehabilitation specialists, insurance administrators and personnel managers.  The seminar will be held on Thursday, March 19th from 9 a.m. to 4:30 p.m. at the Holiday Inn Philadelphia – Cherry Hill.

     

    Mr. Bucci and Ms. Calo are based in the firm’s Camden, NJ office and Ms. Morales is based in the Newark, NJ office.

    Angelo J. Genova Participates in Labor and Employment Relations Association Panel

    Angelo J. Genova participated in a panel discussion for the New Jersey Chapter of the Labor and Employment Relations Association on the topic of, “Bargaining in the Current Economic Climate.”  The panel discussion addressed issues currently confronting labor and management practitioners in New Jersey at the bargaining table due to the unprecedented economic conditions facing state, county and local governments, private employers and their employees.  Other panelists included Lorraine H. Tesauro, Chief Mediator, NJ PERC and Peter Vala, Associate Director Research, NJEA.  Moderating the program was Carmen Gonzalez-Gannon, Assistant Director, UniServ Central, NJEA. 

     

    Mr. Genova currently serves as Chairman of the Section on Labor and Employment Law of the New Jersey State Bar Association.

    Angelo J. Genova Named Fellow of the American Bar Foundation

    Angelo J. Genova, a partner in the Newark, New Jersey office, has been named a member of The Fellows of the American Bar Foundation (ABF).  The Fellows of the ABF is an honorary organization of attorneys, judges and law professors whose professional, public and private careers have demonstrated outstanding dedication to the welfare of their communities and to the highest principles of the legal profession.  Established in 1955, The Fellows encourages and supports the research program of the ABF.  Membership in The Fellows is limited to one third of one percent of lawyers licensed to practice in each jurisdiction.  Members are nominated by The Fellows in their jurisdiction and elected by the ABF board. 

     

    Mr. Genova is active in the American Bar Association and currently serves as Chairman of the Section on Labor and Employment Law of the New Jersey State Bar Association.

    GBV Attorneys Win Bid Protest Dispute Before the New Jersey Appellate Division Involving a $21 Million Anti-Smoking State Advertising Contract

    Through the efforts of GBV Partner, Kathleen Barnett Einhorn, and Counsel, Rebecca Moll Freed, our client, Winning Strategies Public Relations, was awarded a three-year, $21 million anti-smoking advertising contract by the State of New Jersey.  The contract was initially awarded to Winning Strategies Public Relation in July of 2007.  Another bidder, Cedar Knolls advertising firm, Brushfire Inc., disputed the contact award claiming Winning Strategies has ties to a “sister” company which has represented a major tobacco company for two decades.  After a long legal battle that originated at the administrative level, the New Jersey Appellate Division issued a decision on February 5, 2009 upholding the award of the contract to Winning Strategies Public Relations.  Ms. Einhorn and Ms. Freed successfully proved that the campaign was won completely through merit and that claims of a conflict were without foundation.  Ms. Einhorn and Ms. Freed were successful at both the administrative and appellate levels.

    Partner Angelo J. Genova and Counsel Jennifer Borek Win Motion Dismissing Whistleblower Claim After Three Week Trial

    GBV Partner, Angelo J. Genova, and Counsel, Jennifer Borek, won a post-trial motion dismissing a multi-count CEPA complaint against the New Jersey Board of Public Utilities, its President Jeanne Fox, and Chief of Staff Lance Miller.  The Complaint, which was dismissed in its entirety, alleged that the Defendants had engaged in retaliatory conduct against Plaintiff Joseph Potena, after he alerted state Treasury Department officials to his concerns regarding an off-state bank account for the BPU's Clean Energy Program.

    Over approximately three weeks, Mr. Genova and Ms. Borek tried the case on behalf of Defendant Jeanne Fox.  After nine days of testimony, the jury could not reach the required 5-1 consensus on whether the Plaintiff had suffered any retaliation.  On January 23, 2009, in ruling on post-trial motions filed by the defense, Superior Court Judge Andrew J. Smithson dismissed the Complaint, finding that the Plaintiff did not suffer any retaliation.

    Mr. Genova and Ms. Borek were also assisted by Associates Alexander L. D’Jamoos and Emily J. Wexler.  All four attorneys are based in the firm’s Newark, New Jersey office.

    John C. Petrella Participates in Employment Law Roundtable

    GBV Partner John C.
